    Terms and Conditions

    “No Surprises” Guarantee **There will be no additional costs for the work described in this Work Order, even if it takes us longer to complete the work or we need additional materials for the work described in this Work Order.

    “Comfort” Guarantee We guarantee that the equipment we install will perform as agreed upon, as stated in this Work Order. We will provide a comfortable living temperature, (between 70 and 73 degrees F) for the area(s) that we are installing your heating or cooling system.

    “No Lemon” Guarantee We guarantee that when the equipment we installed is maintained and operated in accordance with the manufacturer’s operating and maintenance manuals, should the compressor or heat exchanger fails within the first 5 years... We will replace it with a brand new model, free of charge.

    “$500 No Breakdown” Guarantee If your new system breaks down and we cannot fix it within 24 hours, during the first 2 years of our installation, we will pay you $500.

    “$500 Installation Date” Guarantee If we do not show up on the installation date as we promised (providing the date has not been changed and authorized by both parties), we will pay you $500.

    “Property Protection” Guarantee Damaged property caused by Air, Inc employees will be replaced or repaired in the quickest time possible. Protective shoe covers and floor mats will be used on all high traffic areas.

    General Terms and Conditions

    Definitions: “You”/”Your” means the customer identified in this agreement. “Installation” means the installation services specified in this agreement. Installation professional means Air Inc. or an independent contractor authorized by Air Inc. and their employees, agents, subcontractors, and professionals. “Agreement” means this HVAC InstallationAgreement between you and Air Inc, which includes this page, General Terms and conditions following this page, the Invoice or specifications, and any other documents expressly made a part of this Agreement.

    Scope: This Agreement is between You and Air Inc. Under this Agreement, Air Inc. does perform the Installation directly or through Installation professionals or specialty subcontractors and/or its authorized Sub-contractors. You will pay Air Inc. for merchandise delivery and/or installation according to the terms and conditions of this Agreement. Air Inc. will present this Agreement to You for Your review and signature and/or collect your payment(s) to Air Inc. Installation is limited to and, subject to any Change Order, which will be completed in substantial accordance with the attached Invoice or specifications. 

    Air, Inc. Responsibilities: Air Inc. and all its contractors and/or sub-contractors will complete installation in a workmanlike manner as described in this Work Order. Air Inc. will obtain the required permits for your HVAC installation and provide the permit numbers if required or if otherwise requested by you. Neither Air Inc. nor its contractor/sub-contractors are responsible for identifying property lines, covenants, or other legal encumbrances your service address may be subject to.

    Your Responsibilities: You agree to pay Air Inc. for all merchandise, delivery, and/or for full installation according to the terms and conditions of the Agreement. If your service address is subject to covenants, easements, or other legal encumbrances that could affect installation, you agree to let Air Inc. know before the installation. You agree to facilitate the location of installation free of underground/overhead utility lines. You agree to ensure that work areas are free of pre-existing hazards, i.e., unsafe physical conditions or environmental hazards and building/zoning code violations. You agree to allow Air Inc. and all its professionals with access to sanitary facilities. You agree not to allow unattended minors at Your service address while Air Inc. Professionals are present. You agree to control pets and keep them away from work areas. You agree not to assign or transfer this Agreement. You agree any claims against Air Inc. professionals under this agreement should be made to Air Inc. within thirty (30)? calendar days from the date on this agreement or commencement of work. Air Inc. will attempt resolution of any claims within sixty (60) days of receiving your notice.

    **Changes and Change Orders: Air Inc., at your request, will arrange for our installation professional to perform additional work, subject to a Change Order, subject to additional charges payable by You to Air, Inc. Any changes to this Work Order, i.e., a substitution of materials or an expansion of the scope of the work, will require You and Air, Inc. to first sign a written Change Order that will become part of this Agreement. Any Change Order must be clear in scope and specify any additional payment(s) and/or changes in anticipated start/finish dates. Air Inc. Contractors and /or its Sub-Contractors will not start, conduct, alter or finish installation except in accordance with applicable law. Air Inc. will either not start, or will immediately discontinue, installation upon discovery of unforeseen pre-existing physical or hazardous conditions at your service address, such as, but not limited to, asbestos, faulty electrical wiring, rusted or corroded piping, rotted or insect-infested wood, damaged masonry chimney and etc. Neither Air Inc. nor its contractors or sub-contractors will attempt to repair such conditions until a Change Order, with a complete description of the work needed to be done and the cost associated to complete that work, is approved by You and Air. Inc. Any unforeseen electrical work needed or an electrical upgrade needed to bring to current code, all and any additional charges will be the sole responsibility of you (the customer) and will require a Change Order approval by You and Air, Inc.

    Credit Card Transactions: Your separate cardholder agreement (to which Air Inc. is NOT a party) will determine the total cost of Your purchase, including all interest charges and fees. You will be further subject to Your cardholder agreement’s terms and conditions.

    Financed Transactions: If You are financing this transaction in whole or in part, your separate loan agreement (to which Air, Inc. is NOT a party) will determine (i) the amount financed (the amount of credit provided to You); (ii) the associated finance charges (the dollar amount the loan will cost You); and (iii) the total payment (the amount You will have paid when You have made all the scheduled payments). You will be further subject to Your loan agreement’s terms and agreement.

    Security interest: Liens: If you make all your payments as required under this Agreement, no security interest will be placed against Your property by Air, Inc. If a security interest is placed on Your property, it creates a lien, mortgage, or other claims against Your property to secure payment and may cause a loss of Your property if you fail to pay as requested.

    Cancellation: You may ONLY cancel this agreement without penalty or obligation by delivering written notice to Air, Inc. by Midnight on the third business day after signing. Your payments will be returned to you within ten (10) business days after Air, Inc. receives Your notice.

    All Sales are final. No refunds or discounts will be issued after the expiration of three day right of rescission has expired.

    Restocking Fees: Restocking Fees apply for any merchandise that needs to be returned to Air, Inc’s. distributor, due to canceled work by the customer, after the expiration of three day right of rescission has expired. Prices for restocking fees may vary depending on the scope of the work but not to exceed 25% of the total job cost. The customer is fully responsible for any or all charges incurred by Air, Inc. if work has already started and/or the installation of any equipment has been started or completed.

    Refunds: Refunds will only be made for defective material or damaged materials in transit. To be eligible for a refund, you must first email us at air.inc@comcast.net to alert us of the damage and then make arrangements to return the damaged item to us. Upon receipt of the damaged item, we will issue you a refund or replacement, if requested. If a replacement is not available we will refund the full purchase price of your item. Once your return item is received and inspected, we will send you an email to notify you that we have received your returned item. We will notify you of the approval or rejection of your refund. If you are approved, then your replacement or refund will be processed, and the refund amount will automatically be applied to your credit card or original method of payment, within 30 days.

    THERE WILL BE NO REFUNDS, DISCOUNTS, OR REIMBURSEMENTS FOR CUSTOMER’S LOST TIME OF WORK, UTILITY BILLS, or CUSTOMER INCONVENIENCES. We will do our best to make sure that we work around the customer’s schedule. Unfortunately, there are circumstances that do not allow us to do this. These circumstances are subject to Air, Inc.'s schedule and availability

    YOU MAY CANCEL THIS TRANSACTION WITHOUT ANY PENALTY OR OBLIGATION, WITHIN THREE BUSINESS DAYS FROM THE  DATE OF THE SIGNED PROPOSAL. 

    IF YOU CANCEL, ANY PROPERTY TRADED IN, ANY PAYMENTS MADE BY YOU UNDER THE CONTRACT OR SALE, AND ANY NEGOTIABLE INSTRUMENT EXECUTED BY YOU WILL BE RETURNED WITHIN TEN BUSINESS DAYS FOLLOWING RECEIPT BY THE SELLER OF YOUR CANCELLATION NOTICE, AND ANY SECURITY INTEREST OUT OF THE TRANSACTION WILL BE CANCELED. 

    IF YOU CANCEL, YOU MUST MAKE AVAILABLE TO THE SELLER AT YOUR RESIDENCE, IN SUBSTANTIALLY AS GOOD CONDITION AS WHEN RECEIVED, ANY GOODS DELIVERED TO YOU UNDER THIS CONTRACT OR SALE; OR YOU MAY, IF YOU WISH, COMPLY WITH THE INSTRUCTIONS OF THE SELLER REGARDING THE RETURN SHIPMENT OF THE GOODS AT THE SELLER’S EXPENSE AND RISK. 

    IF YOU DO MAKE THE GOODS AVAILABLE TO THE SELLER AND THE SELLER DOES NOT PICK THEM UP WITHIN TWENTY DAYS OF THE DATE OF THE CANCELLATION, YOU MAY RETAIN OR DISPOSE OF THE GOODS WITHOUT ANY FURTHER OBLIGATION. IF YOU FAIL TO MAKE THE GOODS AVAILABLE TO THE SELLER, OR IF YOU AGREE TO RETURN THE GOODS TO THE SELLER AND FAIL TO DO SO, THEN YOU REMAIN LIABLE FOR PERFORMANCE OF ALL OBLIGATIONS UNDER THE CONTRACT.
